Website terms of use
By using www.train2win.cc you agree to these terms. If you do not agree, please do not use the website.
Information only
Articles, podcasts, videos and other content on this website are general information. They are not personal coaching, medical or nutritional advice. Talk to a qualified professional before acting on them.
Intellectual property
All content on this website (text, images, graphics, logos, training material and podcast episodes) belongs to Train2Win or is used with permission. You may share links to it. You may not copy, republish or sell it without our written permission.
Links to other websites
We link to services such as TrainingPeaks, Podbean and social media. We are not responsible for their content or how they handle your data. Their own terms and privacy policies apply.
Availability
We try to keep the website accurate and available, but we do not guarantee that it is error-free or always online. We may change or remove content at any time.
Coaching terms
These terms apply when you buy a coaching package, the Elite Performance Audit or a training camp. Your contract is with Dana Rožlapa (trading as Train2Win).
3.1 Packages and prices
Current packages and prices are shown on our Pricing page. Prices are in euros and include any applicable taxes. A price change never affects a period you have already paid for. For subscriptions, we will tell you about a price change at least 30 days in advance, and you may cancel before it applies.
3.2 Monthly coaching subscriptions
- Coaching subscriptions are billed monthly in advance, starting on the start date we agree with you. We send you the payment details and an invoice for each payment.
- You can cancel at any time. To cancel, email info@train2win.cc. Coaching continues until the end of the month you have already paid for, and you will not be charged again. We do not refund part-months, except under the guarantee in 3.4.
- You can move to a different package; the change takes effect from your next billing date.
- We may end coaching with 30 days' notice. If we do, we will refund any month paid but not yet started. We may end coaching immediately if you seriously breach these terms (for example abusive behaviour or non-payment).
3.3 Your legal right to withdraw (14 days)
If you live in the EU, you have a legal right to withdraw from a contract made online within 14 days, without giving a reason.
- Most clients want coaching to start straight away. When you subscribe or book, you ask us to start the service within the 14-day period. If you then withdraw, you pay only for the part of the service provided up to that point. Our first-month guarantee (3.4) already refunds you in full, so in practice you pay nothing.
- Once a service has been fully provided within the 14 days (for example a completed Audit), the right to withdraw no longer applies. You agree to this when you ask us to start early.
- To withdraw, send us a clear statement by email to info@train2win.cc, for example: "I withdraw from my contract for [service], ordered on [date]. Name: … Address: … Date: …". You can also use the EU model withdrawal form. We will refund you within 14 days, using the same payment method.
3.4 First-month guarantee
This guarantee comes on top of your legal rights. If a coaching programme is not the right fit, tell us within 14 days of your first payment. We will refund your first month in full, no conditions. It applies to all coaching packages (Core, Performance and Full-Service), once per athlete.
3.5 Elite Performance Audit
- The Audit is a one-time service (price shown on the Pricing page).
- Full refund if you cancel before work starts. Work starts when we begin analysing your data. We will confirm the start date with you in writing.
- After work has started, no refund is due. You keep the written summary and the video analysis.
- If you start a Performance or Full-Service coaching programme within 60 days of receiving your Audit video review, we credit €100 against your first month.
3.6 Training camps
- A deposit of 25% of the total camp price secures your place. The deposit is non-refundable.
- When to pay the balance, cancellation terms and what is included are set out in your camp booking confirmation. Those terms are part of your contract.
- If we cancel a camp, you get a full refund, including the deposit. We are not responsible for travel or accommodation you booked yourself, so we recommend travel insurance.
- Camps are leisure services booked for specific dates, so the legal 14-day withdrawal right (3.3) does not apply to them.
3.7 Your health and safety
Endurance training carries risks. By starting coaching you confirm that:
- you will answer the health questions in our onboarding form honestly, and tell us promptly about any illness, injury, medication or change in your health;
- you will get medical clearance from a doctor before starting if you have, or are unsure whether you have, a heart condition, high blood pressure, chest pain or fainting during exercise, diabetes, a recent serious illness, injury or surgery, or pregnancy, or if you are over 35 and starting hard training after a long break. We may ask to see confirmation that you have been cleared, and may pause coaching until we receive it;
- you train within your own limits and stop and seek medical help if you feel unwell;
- you follow traffic laws, use proper safety equipment and are responsible for your own equipment.
We are coaches, not doctors. Our guidance is not a medical diagnosis or treatment. When we review blood work, lactate tests or other physiological data, we do it to guide training, not to make medical judgements. If anything looks medically relevant, we will tell you to see a doctor.
3.8 Junior athletes (under 18)
Coaching for an athlete under 18 is contracted by a parent or legal guardian, who pays, accepts these terms and gives consent for the junior's data (see 4.9). The parent or guardian stays responsible for the junior's health declaration and medical clearance.
3.9 Your responsibilities
- Give us accurate information and access to your training data (for example TrainingPeaks).
- Pay on time.
- Keep the training plans and material we send you for your own use; do not share or sell them.
3.10 Results and liability
Training outcomes depend on many factors outside our control, so we cannot guarantee specific results, race outcomes or selections.
We are liable for harm caused by our negligence or wilful misconduct, and nothing in these terms limits liability that cannot be limited by law (including liability for death or personal injury caused by negligence). Otherwise, our total liability for a service is limited to the amount you paid for it in the 12 months before the claim. We are not liable for injury or illness caused by not following our guidance, by hiding health information, or by training against medical advice.
3.11 Testimonials, photos and results
We publish your name, photo, quote or results on our website or social media only with your permission. You can withdraw permission at any time, and we will remove the content from our channels within a reasonable time.
3.12 Law and complaints
These terms are governed by Spanish law. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer laws of that country. You can bring a claim in the courts of your home country or of Spain.
If you have a complaint, email info@train2win.cc first; we aim to reply within 14 days. You can also contact your local consumer authority. In Spain, consumers can ask for an official complaint form (hoja de reclamaciones) or use the consumer arbitration system (Sistema Arbitral de Consumo).
Privacy Policy
This policy explains how Train2Win collects and uses your personal data, in line with the EU General Data Protection Regulation (GDPR) and Spain's data protection law (LOPDGDD).
4.1 Who is responsible for your data
The data controller is Dana Rožlapa (Train2Win), NIE Z0419289-G, Calle Masil 1B, 03769 Sanet y Negrals (Alicante), Spain, info@train2win.cc. We have not appointed a Data Protection Officer; contact us at the email above for anything about your data.
Coaches who work on behalf of Train2Win (including Jānis Mūsiņš) access athlete data only to coach you. They are bound by a written confidentiality and data processing agreement.
4.2 What data we collect
| Category | Examples | Where it comes from |
|---|---|---|
| Contact and identity | Name, email, phone, country, date of birth | Forms, bookings, emails |
| Payment | Subscription and payment records (we never see your full card details) | Our payment provider or your bank |
| Training data | Workouts, power, heart rate, GPS routes, training load, race results | TrainingPeaks and connected devices/apps you link |
| Test and physiology data | Lactate tests, INSCYD and other performance tests, body weight and body composition | Tests we run or results you send us |
| Health data | Medical history, injuries, illness, medication, blood test results, heart rate variability, menstrual cycle information if you choose to share it | Onboarding form, documents and messages you send us |
| Communication | Emails, messages, call notes, call recordings (only if you agree at the start of the call) | You |
| Website use | Pages visited, device and browser, cookie identifiers | Cookies (see section 5) |
Health data is a special category of data under the GDPR. We use it only with your explicit consent and only to coach you safely.
4.3 Why we use your data and on what legal basis
| Purpose | Legal basis (GDPR) |
|---|---|
| Replying to enquiries and booking the free intro call | Steps before a contract at your request (art. 6.1.b) |
| Providing coaching, the Audit and camps: plans, analysis, feedback | Contract (art. 6.1.b) |
| Using health and physiology data to coach you safely | Your explicit consent (art. 9.2.a) |
| Payments, invoices and accounting | Legal obligation (art. 6.1.c) |
| Analysing data with software and AI tools to prepare your coaching (see 4.5) | Contract, and for health data your explicit consent |
| Telling you when SpartaGYM on demand opens, if you join the waitlist (name and email) | Consent (art. 6.1.a), given with the tick box on the form; you can withdraw it at any time |
| Publishing testimonials, photos or results | Consent (art. 6.1.a) |
| Website statistics and advertising cookies | Consent (art. 6.1.a), given through the cookie banner |
| Keeping the website secure; defending legal claims | Legitimate interest (art. 6.1.f) |
We do not sell your data. We do not make decisions about you based only on automated processing: a coach reviews every plan and recommendation.
4.4 Who we share data with
We use trusted service providers ("processors") who handle data only on our instructions:
| Provider | What for |
|---|---|
| Squarespace (including Acuity Scheduling) | Website, forms, booking and onboarding form |
| TrainingPeaks | Training platform and training data |
| INSCYD | Performance testing and analysis |
| Microsoft (OneDrive) | Secure storage of athlete files |
| Google (Gmail / Google Workspace) | Email and documents |
| Google Analytics (Google Ireland Ltd; Google LLC, USA) | Website statistics: which pages are visited and how visitors find the site. Used only if you accept statistics cookies (consent, art. 6.1.a) |
| Anthropic (Claude) | AI-assisted analysis of training and test data (see 4.5) |
| Podbean | Podcast hosting and player |
Payment providers (PayPal for existing subscriptions, or your bank for bank transfers) process your payments as independent data controllers under their own privacy policies.
WKO5 analysis software runs locally on our coaches' computers; it is not a cloud service.
Meta (Facebook/Instagram): if you accept marketing cookies, the Meta pixel sends Meta information about your visit so we can measure and target our adverts. Meta and Train2Win are jointly responsible for this collection. Meta's own privacy policy covers how Meta uses it afterwards.
We may also share data when the law requires it (for example with tax authorities), or with our accountant (gestoría) for invoicing.
Transfers outside the EU: several of these providers are based in the USA or store data there. Those transfers are protected by the EU-US Data Privacy Framework (where the provider is certified) or by the European Commission's Standard Contractual Clauses. You can ask us for details.
4.5 Use of AI tools
We use AI assistants (Anthropic's Claude) to help organise and analyse training files, test results and blood work, and to prepare notes for your coach. A coach always reviews the output; AI never makes coaching or health decisions by itself. We have switched off the setting that allows our conversations to be used to train AI models. We share only the data needed for the analysis. You can ask us not to use AI tools on your data. We will respect that, though some analysis may take longer.
4.6 How long we keep your data
- SpartaGYM on demand waitlist (name and email): until you unsubscribe, or at most 6 months after the library opens.
- Athlete data (training, test, health data and coaching records): until coaching ends, then deleted 2 years after your last service. You can ask for earlier deletion at any time.
- Enquiries from people who don't become clients: up to 12 months.
- Invoices and payment records: 6 years, as required by Spanish commercial and tax law (Código de Comercio art. 30; Ley General Tributaria).
- Testimonials and photos: until you withdraw your consent.
- Website statistics (Google Analytics): deleted automatically after 14 months.
- Cookies: see section 5.
4.7 How we protect your data
Access is limited to the coaches who work with you, on password-protected accounts and devices. Every coach and provider is bound by confidentiality. If a data breach puts you at risk, we will tell you and the Spanish data protection authority as the law requires.
4.8 Your rights
You have the right to:
- access your data and get a copy;
- correct inaccurate data;
- delete your data;
- restrict or object to certain uses, including any use based on legitimate interest, and all direct marketing;
- data portability: receive your data in a common format, or have it sent to another coach;
- withdraw consent at any time (for example for health data or photos). This does not affect what we did before you withdrew. Without health data we may not be able to coach you safely, and we may then need to end coaching.
Email info@train2win.cc to use any of these rights. We will reply within one month. If you are not happy with our answer, you can complain to the Agencia Española de Protección de Datos (www.aepd.es) or to the data protection authority in your own EU country.
4.9 Children
For athletes under 18, a parent or legal guardian gives consent and receives this policy on the junior's behalf. Juniors aged 14–17 can also exercise their data rights themselves. We collect only the data needed to coach the junior safely.
4.10 Changes to this policy
We will update this page when our practices change and show the date at the top. If a change is significant, we will tell our current clients by email.
